How Could You? Hall of Shame-Gary Foster UPDATED

This will be an archive of heinous actions by those involved in child welfare, foster care and adoption. We forewarn you that these are deeply disturbing stories that may involve sex abuse, murder, kidnapping and other horrendous actions.

From Lexington, Kentucky, 63-year-old foster and adoptive father of 5, Gary Foster  “faces 72 counts of having sex with someone who was older than 12 but younger than 18, and 121 counts of having unlawful sex with an older victim.” He fostered special needs children. These charges are for incidents dating from 1992 to 2009.

Update: According to the Kentucky Court of Justice, he has a pretrial conference set for January 17,2012  and a jury trial set for June 25, 2012.

Update 2: “A plea agreement has been offered to the Campbellsville foster parent who has been charged with nearly 200 counts of a sex-related crime.

Last March, Gary Foster, 63, of 1167 Lone Valley Road, was indicted by a Taylor County grand jury and charged with 72 counts of having sex with someone who was older than 12 but younger than 18 at the time, and 121 counts of having unlawful sex with someone older than 18. The indictment alleges Foster committed the crimes from Jan. 1. 1992, to Dec. 18, 2009.

Foster appeared before Taylor Circuit Court Judge Allen Bertram on Tuesday [February 21, 2012].

The hearing lasted four minutes. His attorney, Brenda Popplewell of Somerset, was in court in Somerset and did not attend the hearing.

However, local attorney Bryan Bennett represented Popplewell.

Bennett told Bertram that the prosecutor in the case, Assistant Commonwealth’s Attorney Shelly Miller, has offered Foster a plea agreement. No details of the agreement were discussed.

Bennett said Popplewell and Miller have discussed setting the case for a day in March to see if it could be worked out before then.

Bertram set a pretrial hearing for Tuesday, March 20.

Bennett said Popplewell could soon file a motion pertaining to Foster’s bond, which was set at $100,000 and posted. He said the motion could ask for part of that money to be released.

As of press time, that motion hadn’t yet been filed.

Popplewell did not return a phone call from the News-Journal office by press time to comment.
Kentucky State Police Trooper Andy Olson investigated the case against Foster.

KSP Public Affairs Officer Billy Gregory said last March that Foster was a foster parent who worked with special needs children.

A Hope International newsletter written in 2005 contains a column written by a man named Gary Foster. In the column, Foster states that he had been a Bible worker at the Seventh Day Adventist Church in Campbellsville and that he and his wife had adopted five children. The address listed for the Seventh Day Adventist Church Reform Movement is the same as Foster’s Lone Valley Road home.

The charges against Foster that involve the younger victim are Class B felonies, each punishable by as much as 20 years in prison. The other charges are Class C felonies, punishable by as much as 10 years in prison each. As such, Foster faces as much as life in prison.

Bond was set at $100,000 cash. Foster was ordered to have no contact with his alleged victims.
Foster is scheduled to face a jury of his peers on Monday, June 25.”

In March 2012, Gary Foster pled guilty to “one count of having unlawful sex with someone older than 18. The remaining charges were dismissed.”!

“The Campbellsville foster parent charged with nearly 200 counts of a sex-related crime has pleaded guilty and could receive probation for his crime.He could also be ordered to never serve as a foster parent again.Gary Foster, 64, of 1167 Lone Valley Road, was indicted last March by a Taylor County grand jury and charged with 72 counts of having unlawful sex with someone who was older than 12 but younger than 18 at the time, and 121 counts of having unlawful sex with someone older than 18. Miller has also recommended that Foster be required to register as a sex offender and complete sex offender treatment.

It was also recommended that Foster be ordered to not have contact with any minor children, any children living in his home or the victim, and that he no longer be allowed to foster children.

Court records state that the victim asked that the majority of the charges against Foster be dismissed after claiming that the sex between them only occurred once after the age of 18.

Formal sentencing has been set for Tuesday, May 22.

Miller declined to comment on her recommendation.

During the hearing, Popplewell asked Bertram if some of the $100,000 bond posted to release Foster from jail could be released. She said not having that money has caused hardships for the Foster family.

She said Foster has appeared at all his court hearings and will continue to do so. Bertram agreed to release $95,000 of the $100,000.

Neither Popplewell nor Bennett returned a phone call to comment before press time.

A public search of Kentucky court case records shows that sentencing will occur on July 24, 2012.
Update 4/July 30, 2013
No more media articles were found. A search of the Kentucky jail system found that he was sentenced to 5 years in prison for “incest” /Felony Class C. He was incarcerated on July 26, 2012.

The previous update was WRONG. He was only sentenced to 5 years PROBATION ,not jail.
“A registered sex offender is accused of sexually abusing a child.Gary Foster, 66, used to be a foster parent and cared for special needs children.

The Central Kentucky News Journal reports the Campbellsville man has been indicted by a grand jury.

He’s charged with sodomy of a victim younger than 12. The paper also reports that in 2011 Foster was charged with 72 counts of having unlawful sex with a juvenile.

He was sentenced to five years probation in 2012 and ordered to register as a sex offender.”
