CPS Reprimanded: Darcy and Tye Miller Case
From Houston, Texas, CPS has been reprimanded for ” not justifying removal of premature infant twins from their parents’ custody.”
“District Judge Michael Schneider called CPS removal of the infant daughters of Darcy and Tye Miller of Spring a “groundless cause of action” and ordered the agency to pay their $32,000 legal bill.”
Their daughters were ill since their birth and developed bronchitis. “According to court documents, the twins were born in December, and the Millers had taken them to their pediatrician almost weekly because of concerns about their weight.” At the hospital it was discovered that there were healing rib fractures, later deemed NOT to be due to abuse. The Miller’s tried to comply as best they could by voluntarily allowing CPS to give custody to relatives, but CPS took emergency custody five days later.
“CPS did not notify the parents of the custody hearing or inform the judge of the voluntary custody arrangement it had agreed to with the Millers.”

Coughing can cause rib fractures, especially accompanying serious lung infections in fragile populations like premature babies.
