930 Pages of Evidence Released in the Nubia and Victor Barahona Case UPDATED

“Lawyers for the Barahonas tried to seal the evidence before trial, saying it would taint the jury pool, but the state attorney’s office in West Palm Beach released the documents.
According to some of the pages, Jorge Barahona told authorities that Nubia tried to poison him by putting baby oil in his soda. He also says he gave Nubia and her twin brother, Victor, allergy and sleeping medicine to sedate them in the days before Feb. 14th.
According to interviews with firefighters and police who responded to the crime scene– they described it as “grim.”
Young Nubia’s body would eventually be discovered stuffed in black plastic bag in the bed of her adoptive father’s truck. She was naked — in a fetal position– her sex not recognizable.
One firefighter said her face looked like a mannequin. It wasn’t until he touched her face that the firefighter realized it was a human being.
22 bags of evidence were also taken from Jorge Barahona’s pickup truck that day.
Carmen has stated that she and her husband were separated at the time of the Nubia’s death. In interviews with investigators she states how she was afraid OF him and that he had a terrible temper.
Carmen and Jorge Barahona are both facing first degree murder, child abuse and child torture charges in this case. They have both pleaded not guilty.
A trial date has been set for July.
The prosecution is seeking the death penalty.”

The pdf contains detailed evidence collected at the Barahona house and in the truck; firefighter, paramedic and hazmat statements and details; Florida abuse hotline transcripts of granddaughter’s psychologist call and the call about the open cleft palate wound of Victor (appears to be from Jorge’s sister Laura); phone records; interviews with Carmen Barahona; interviews with the other two children that lived in the house; a suicide note of Jorge Barahona from September 2006; interview with Jennifer Perez (Carmen’s adult daughter); interview with Jorge’s sister Laura; search warrants; property tax information; credit histories and more.
Other evidence not detailed in the above article include the following:
- Nubia’s body had ligature marks and scarring consistent with abuse, especially restraining methods
- Nubia’s body had a damaged sphincter muscle (no sphincter tone)
- Her body was described by 2 firefighters as resembling a doll or mannequin with a lot of discoloration of the skin and brown streaks and placed legs crossed “indian-style” and in the fetal position.
- Statement from the autistic foster son that Nubia and was beaten with Jorge’s shoe by Jorge. The granddaughter also said she was beaten with Jorge’s shoe by Jorge.
- Both of the other children stated on their own that Nubia was not dead, though that was not a question asked of them
- The neighbor who reported a foul odor and swarms of flies coming from the Barahona house detected that odor within a week prior to Valentine’s Day (the day that the truck was discovered near the highway). This differs from previous reports that indicated the odor around Christmas.
- The foster son indicated that Nubia did not have a bedroom and slept in the bathtub and was in the bathtub the whole day. Carmen would bring her food to the tub and untie her to eat.
- The foster son said that the children were fed in their rooms.
- When asked about Carmen, he said “deep in the dark side, she’s mean”
- Carmen accuses Victor and Nubia of molesting her granddaughter and that is the basis for the bathtub treatment. Carmen’s statement would refer to the foster son and her granddaughter as my kid, but not refer to Victor and Nubia that way. She accuses them of poisoning food because the other children had green diarrhea.
- Carmen worked in bill collections in a pediatrician’s office.
- Carmen says that Jorge was homeschooling the kids.
- Carmen says that Victor and Nubia had not been to the dentist for a long time.
- Carmen says that Victor and Nubia would throw things in the pool for the autistic foster son. When he would dive for it, they would sit on him and try to drown him.
- Victor was found in the truck with only shorts on (no shirt, socks or shoes) with pink stuff around his mouth and pink/white pills or candy on the floor that matched the substance around hs mouth.
- Victor had suspected chemical burns on chest, groin and legs. His skin had a pH of 0 indicating a strong acid.
- Victor had injuries consistent with binding/restraining his wrists and choking-type injuries to his throat.
Update: “A member of the investigative team appointed by the Department of Children and Families after a 10 year-old girl was found dead in her adopted father’s truck is calling the information in the newly released documents in the case evil.David Lawrence was one of three panelist assigned to investigate the Barahona adoption case. He said he wasn’t surprised to learn Jorge Barahona claimed his adopted 10-year-old daughter Nubia Barahona and her twin brother were trying to poison him with rat poison, according to the documents.”This is a good example of evil and wrongdoing as anything I can remember,” said LawrenceThe new information was revealed in documents released by the Palm Beach County State Attorney’s Office.”
