From Melbourne, Florida, Russia reports that adoptee Maxim Babayev’s adoptive parents Shad and Christine Traylor were arrested on October 25, 2011 “on suspicion of maltreating the adopted  son, but the court found them not guilty and closed the  case.”

“Both child welfare services courts in Florida refused to inform Russian diplomats about details of the case, or about the boy’s condition and life,” Zakharova said.

“Unfortunately, neither the local authorities, nor the U.S. Department of State, informed the Russian Embassy in Washington about the incident,” she said. ”

“The Russian Foreign Ministry has demanded explanations from the United States concerning the situation surrounding the adopted Russian boy Maxim Babayev, who fell victim to home violence.

“The Russian Foreign Ministry was alarmed by reports that underage Maxim Babayev has fallen victim to violence in his adoptive American family,” Russian Foreign Ministry spokesperson Maria Zakharova said in a commentary.

“We are going to raise this issue during the Russian-American consultations being held in Moscow now on the implementation of the agreement on cooperation in the child adoptions sphere,” she writes.

“We demand that the American side provide exhaustive explanations and establish Babayev\’s whereabouts in order to organize a consular meeting with the boy. We will continue doing all we can to defend his rights and interests,” Zakharova said.”

“A couple from Florida’s Brevard County were arrested last year on charges of cruelty to their foster son, an underage Maxim Babayev from Russia. Recently a US court has dismissed all charges against Shad and Christie Taylors [sic].

The Russian Foreign Ministry has demanded explanations from the United States and insisted the abused kid should be located and meet an official with the Russian Consulate.

Moscow also vowed to bring this case to the negotiating table at the ongoing US-Russia consultations on implementation of the bilateral adoption agreement.”

Update: “Russia’s Foreign Ministry hopes that those responsible for abusing 6-year old Russian Maxim Babayev, adopted in the U.S., will undergo due punishment. This was stated by a representative of the Russian Foreign Ministry, Konstantin Dolgov.
He added that the Russian Foreign Ministry and embassy in Washington were keeping the issue under constant control. However, until now “a concerned, adequate approach to Babayev’s case on the part of the American authorities has not been evident. Thus, they have still not allowed consular visits to the child,” said Dolgov.

Husband and wife Shed and Christy Tailor[sic], who adopted the child, were arrested last year in Florida for alleged child abuse.

The court subsequently withdrew all charges and released the foster parents.”

Russia’s Foreign Ministry demands punishment for abusive foster parents

“Russia has asked the US to review abuse cases involving adopted Russian children, claiming that more lenient sentences are given in those cases where the victims are Russian-born than US-born.

The statement was made by Russia’s Foreign Ministry, which says it wants to study evidence from several recent high-profile trials for rape and abuse of adopted children that have made headlines in the Russian media over the past week.

Official Ministry spokesperson Alexander Lukashevich said that this applies in particular to Maxim Babaev who was the victim of violence while living with an American family in Florida and three-year-old Denis from the Voronezh region, who was abandoned by his foster mother in Massachusetts.

Lukashevich said that in two weeks a bilateral agreement on cooperation in the field of adoption between Russia and the U.S. will come into force.

Russia expects that the Department of State will be responsible for enforcing the execution of the agreement and will continue to promptly inform the Russian authorities of such incidents and take comprehensive measures to ensure the rights of Russian minors.

The US is a top destination for Russian orphans, and the two countries recently signed a new adoption agreement after years of squabbles.”

Update 2: “The verdict handed down by a U.S. court to the foster parents of a Russian boy, Maxim Babayev, is surprisingly mild, the Russian Foreign Ministry’s envoy for human rights, democracy and the supremacy of law Konstantin Dolgov said on Tuesday.

Despite their immoral behavior and physical abuse of the six-year-old boy, Laverne [sic]and Christie Taylor [sic], received five-year and one-year suspended sentences respectively.

The fact that Russian consular officials have not been allowed to visit the boy for unclear reasons arouses dismay, the envoy said.

He added that the situation around Maxim Babayev was yet another proof of court bias in cases of abuse of children adopted from Russia.”

US couple gets suspended sentences for abusing adopted Russian son

“Russia’s chief children rights ombudsman Pavel Astakhov has slammed the US over “unreasonably mild sentences” given by a US court to a couple accused of abusing their Russian adoptee.

“The policy of double standards and unreasonably mild sentences given to American abusers of Russian children do not fit into the bilateral dialogue we are engaged in with Americans,” Mr. Astakhov was cited as saying.

A Florida court has terminated parental rights of Shad and Christie Taylors who mistreated their Russian son, Maxim Babayev. The father has been handed five years of probation, while the mother got away with just one year. The couple was also deprived of any adoption rights for the rest of their lives and will be placed in a correction program.

Mr. Astakhov also insisted Maxim Babayev must be consulted by Russia’s consulate.”

Update 3: “Florida justice denied Russian diplomats a meeting with adopted Russian boy, Maxim Babaev, 6, who was abused by his American adoptive parents, despite US-Russian new agreement on adoption. Sergey Chumarev, Senior Legal Councillor of the Russian Embassy in the U.S., who tried to get consular access to Maxim, a bearer of Russian passport, told the Voice of Russia about the new details of this case. In the most shocking part, Mr. Chumarev refers to sheriff’s report about sexual abuse of the child that was disregarded by a local judge, as well as to police report saying the adoptive father hit his head against the wall and his U.S. mother tried to suffocate him. The Russian diplomat also cites other examples when state or county authorities in various locations across the United States refused to fulfill US-Russian adoption agreement and prevent Russia to monitor cases of abuse of Russian kids in America. This story emerges on the backdrop of heated debate around U.S. adoption ban that was voted by the Russian Duma past Friday.”

“Please tell us about your trip to Florida and how you met those adopted Russians who were reportedly abused?

I have just returned from Florida, that was a short to Brevard County. I had an opportunity to talk to five different officers there trying to get access to Russian national minor whose name is Maxim Babayev who was adopted here and given a name Maxim Tailor.

How old is he?

He is six years old. We contacted the office of the State Attorney General, Brevard County sheriff’s office, records department and the clerk of the local court. And what we got was a very cautious and at the same time very strange response to our requests. First, we could not meet with the boy, though he is a Russian national and he is apparently in need of consular and diplomatic protection.

Second, we got some public records but they are heavily reducted. Basically, what we could obtain as the background information for this case is the sheriff’s arrest report, charges against both adoptive parents and the judgment. And out of that we already can indicate very serious issues with respect to the quality of treatment of this case. And if you allow me, I would single out one very important issue.

Both parents, we believe that they deserve a much severe punishment. For the adoptive father it was five year probation and for the mother one year probation, though as we can judge from the public records available to us they really were striking and hitting him at the wall and squeezing neck of this boy with hands

And that was made on public, you’ve mentioned, right?

Most probably it was not a single incident because the doctor who actually examined the boy immediately after arrest, he testified that there were numerous injuries on the body and some bruises on the back side of his head. So, the injuries were really serious and the boy was immediately separated from this family. As we also managed to learn is that right now he stays with the foster family and receives medical and psychological assistance.

But the main reason and the main purpose of our visit was not achieved because prior to this visit the local judge twice rejected our motion as for the consular access to this boy. And basically he disagreed with the statement of the State Department that in such cases where a child is a victim of severe maltreatment, a visit of consular representatives from his country of origin is in the best interests of this child. And the judge decided to follow only Florida rules and local laws and regulations. He also stated that he does not know basically about the consular bilateral convention and the recent agreement on cooperation in international adoption between Russia and the US, and he is not obliged to implement those treaties.

That is a structural issue for us since this case shows that the US authorities cannot assure implementation of international obligations in every part of the US territory. And since it concerns the Russian national and the minor – it means that we have to find new means to tackle this issue. And probably the most appropriate would be a joined visit by the Guardian Ad Litem, social protection services and other representatives in a joined cooperative effort to finally identify the boy, to assist him with the documentation because apparently his Russian passport has been lost or even destroyed by adoptive parents, which is a common practice unfortunately.

And what was the reason for the judge, did he explain why he is not allowing you to visit the boy?

He had a ten minute oral ruling and that was quite large in terms of words but in substance though that was quite poor because his idea was that he is not convinced that the visit of consular officials would serve the best interests of the child, as he sees it. That’s it. On his way to this conclusion he rejected our arguments, he rejected the arguments presented by the State Department and also informed that he is not in a position to apply international treaties in this particular case, he does not need it.

Does the Embassy want to go further and ask for further assistance from the State Department in this dialog with the Florida authorities?

Yes, we will continue dealing with this case, specifically on a very important issue that has been overlooked by the American court. We’ve managed to find out that there were also some charges that were disregarded and in the judgment we can read that the state in consideration on this plea agrees not to file sex-related charges against the defendant.

So, you mean the sexual abuse. And you said that it was mentioned in the sheriff’s report, right?

Exactly! And this sheriff’s report was kind of disregarded by the judge, by the office of the prosecute, the attorneys office and it means that this particular case needs to be further investigated, and if necessary, new charges should be brought against these adoptive parents. Otherwise, we feel that it is yet another case when American courts just did not serve the best interests of the child and actually whitewashed horrendous actions by adoptive parents. We will continue working with the State Department and local authorities. And we hope that in accordance with the Florida law, international obligations and federal law of the US we will finally find the real solution for the best interests of the child.

  1. As an attorney whose specialty is not family law, it seems to me the Russian Goverment was in the wrong Court. It seens to me the attempt to enforce the bilateral agreement between USA and Russia in a particular instance or in regard to a particular child would require an action in Federal Court.

    • Could you explain how that would work for children that are state wards? How does a federal court have jurisdiction over a state ward?

  2. I live in Melbourne, Florida, and I am Russian. Is it at all possible to meet a child and to talk with him? My heart goes out to the poor kid! My younger daughter was six when we arrived to Florida from Russia, Even for her, surrounded by family, the adaptation was a difficult road to travel…
