How Could You? Hall of Shame-India-Shri Ram Audyogik Orphanage

From Lucknow, India, the Shri Ram Audhyogik Orphanage, which claims to house up to 20 orphaned children  in Class 1 through Class 9 is accused of lying about the background of a child and adopting out the child .

“A woman from Barabanki is seeking custody of a child given away to a couple from Rajasthan by a Lucknow orphanage. The superintendent of the orphanage had submitted to the court that the child was born to a mentally retarded woman and was adopted by them after police verification, but the woman has a DNA test report to prove that she is the biological mother. Lucknow bench of the Allahabad High Court will decide on May 27.

Justice Vishnu Chandra Gupta issued notices to adoptive parents, superintendent of Shriraam Audyogik Orphanage, Aliganj, Ruchi Tripathi and president of Child Welfare Committee, Barabanki to appear before the court on May 27 when the court decides the fate of the child, whether he should remain with the adoptive parents or be handed over to Nisha, a resident of Barabanki.

Nisha filed a habeas corpus petition before the high court on January 31, 2013 seeking custody of her child, who has been rechristened by the adoptive parents Siddhartha. The court had issued notices to CWC and Ruchi Tripathi, who appeared before the court. Superintendent of the orphanage told the court that Siddhartha was born to a mentally retarded woman Jagrani, a resident of Asandra in Barabanki. The baby was taken to the orphanage after police verification on May 21, 2012. Subsequently, the baby was adopted by a couple Satyendra Soni and Meenakshi Soni, residents of 646, Adarsh Nagar, Jaipur, Rajasthan after starting proceedings for adoption on July 2, 2012.

Nisha strongly countered the superintendent’s claim and sought DNA test of the baby. Considering the seriousness of the matter, Justice Gupta directed the director of Sanjay Gandhi Post Graduate Institute of Medical Sciences on March 22, 2013 to collect DNA samples of the baby and the petitioner and conduct the test, the cost of which would be borne by the state government. The sample was collected and Suraksha Agarwal, professor of the department of medical genetics, SGPGI prepared the DNA report and found that the baby was born to Nisha.

When the report was submitted to the court on April 30, it strong note against the superintendent of the orphanage for making wrong statement pertaining to the baby’s background. It summoned superintendent Ruchi Tripathi to show cause why she should not be punished for making false statements to the court and legal actions not be taken against her, and why she should not be directed to deposit Rs 25,400 incurred on the DNA test. The court also issued notices to the adoptive parents asking why should the adoption deed not be cancelled in view of the DNA test report.”
