How Could You? Hall of Shame-Michael Vargas, Sr. UPDATED

This will be an archive of heinous actions by those involved in child welfare, foster care and adoption. We forewarn you that these are deeply disturbing stories that may involve sex abuse, murder, kidnapping and other horrendous actions.

From Clovis, New Mexico, foster parent Michael Vargas, Sr. ,40, was found guilty of “24 counts of Child Abuse, all third degree felonies.  The two-day trial concluded today at the Curry County Courthouse.

In October of 2010, two children reported to a social worker at their elementary school that they were being tazed by their care takers. The children, who were in foster care of Michael Vargas, Sr., had been tazed at least 24 times resulting in burns to their stomachs and arms. The abuse had occurred over a period of two months.  
Andrea Reeb, Chief Deputy District Attorney, prosecuted the case for the State. Vargas was represented by criminal defense attorney, Jennifer Burrill.  The Honorable Teddy L. Hartley presided over the case and immediately remanded Vargas into custody on a $25,000.00 cash only bond.  The Judge ordered the adult probation office to prepare a pre-sentence report before sentencing.  Vargas faces 72 years in prison.
“It is unconscionable that anyone would ever consider using a stun gun device to punish a child,” said District Attorney Matthew Chandler. “I commend the children in this case for having the courage to come forward and put their abuser behind bars.”

Update: “A Clovis man convicted in June of abusing his foster children with a stun gun was sentenced Wednesday to 16 years in prison, according to District Attorney Matt Chandler.

Michael Vargas, 40, was found guilty of 24 counts of child abuse, all third-degree felonies.

Chandler said in October 2010 two children reported to a social worker at their elementary school that they were being tased by their foster family. The abuse had occurred over a two-month period, he said. The older child of the two had 24 burn marks when he was examined. Chandler described it as, “a cruel and ruthless act.”

“It is unconscionable that anyone would ever consider using a taser as a means of punishment,” said Chandler. “The victims in this case are relieved that all of this is over, and they can now focus on the things kids are supposed to focus on.”

In addition to his 16-year sentence, Vargas will have serve an additional five years of supervised probation and parole. Due to Vargas committing a serious violent crime, he will have to serve at least 85 percent of his sentence before he is eligible for parole.

“I commend the children in this case for having the courage to come forward and put their abuser behind bars,” Chandler said.”

      How did these “problems” result in 24 tazer burns on one kid’s body? RAD-generated stigmata?

      That’s sure to show up on some AT proponents’ bogus RAD checklist soon: “Child is capable of willing suspicious injuries to appear on his body for the purpose of getting his APs investigated for child abuse.” *rolls eyes*

      This guy had his day in court, and was found guilty.

  4. My farther is innocemt im adopted nd i have been living with gum sibce i was born dont you think i would have reported him this man is my hero cauz he saved me by taking me in he couldnt left me be but no my dad took me in and fed me bathed me and he even help increase my football skills

    • Could you really have reported him for abusing your foster siblings, given that he’s your “hero”, and that you credit him for “saving” you?

      Just because he never tasered you (I’m assuming that’s what you’re saying) doesn’t mean he didn’t taser the foster kids. Parents who do a good job parenting children they’ve raised from birth sometimes can’t handle older kids who enter the family with behavior problems. The honest thing to do in these cases is to tell CPS that you’re struggling and ask for help. Using a taser as a punishment is NEVER okay, no matter what.
