How Could You? Hall of Shame-Ukraine Adoptive Parent Lev Dzyuba UPDATED

This will be an archive of heinous actions by those involved in child welfare, foster care and adoption. We forewarn you that these are deeply disturbing stories that may involve sex abuse, murder, kidnapping and other horrendous actions.

From Conyers, Georgia, Ukraine adoptive parent Lev Dzyuba, 37, and  his two sisters, 21-year-old Alina Dzyuba and 26-year-old Natalia Mellon were charged “with cruelty to children and false imprisonment” of his three children –an 8-year-old girl and a 10-year-old and 12-year-old boy–who were adopted “about a year ago” from Ukraine. Lev’s wife died of cancer shortly after the adoption.

“The children have been placed into protective custody by the Division of Family and Children Services.”
“A family member of Dzyuba, Lacya Kucheryavaya, said that Mr. Dzyuba has lived at the Conyers home for about 12 years. He and his wife adopted the three Ukrainian children about a year ago, she said. Shortly afterward, Dzyuba’s wife passed away from cancer, and his two sisters stepped in.

“It is overwhelming. With his wife having passed away, he knew that he would need extra help and attention to pay attention to the kids,” said Kucheryavaya.

Kucheryavaya says the children were homeschooled by the sisters while their father worked at his air conditioning business. She believes the child cruelty and false imprisonment charges against the three are a big misunderstanding.

“I do believe justice will be served. His story will be heard and all this will be figured out, but I know that Lev would not do anything out of the ordinary or extreme,” Kucheryavaya said.

The suspects remained at the Rockdale County jail on Thursday night. They were expected to make their first court appearance on Friday.”

“A Rockdale County home became a prison for three children locked up in their rooms by their own father, according to investigators.

Neighbors around the home, on Hull Drive, told Channel 2’s Carl Willis that nearly everything appeared normal from the outside. The only change was that they had not seen the children in months.

“It’s a sad situation,” said neighbor Cathy Morris. “We just don’t know what’s going on behind closed doors.”

“We’re hearing this more and more,” she said. “You’ve got Ohio and different places, so it’s a little disconcerting.”

Wednesday, deputies arrested 37-year-old Lev Dzyuba and his sisters, 20-year-old Alina Dzyuba and Natalia Mellon, on suspicion of false imprisonment and cruelty to children.

A basketball hoop in the driveway, a swing set in the back yard and Dzyuba’s van from his air conditioning and heating company near the garage would hardly attract a second look.

Inside, however, investigators said the children’s rooms were far from normal.

“I don’t want to go into the details, but I’ll just say it was secured more than you would secure a room in your house normally,” said Capt. Chris Traylor.

Thursday, investigators searched the home and crawled into the crawl space to look for evidence in the home where, they said, Dzyuba’s 8, 10 and especially his 15-year-old son were held captive.

“The information we have is they haven’t been out of the house in two months,” said Traylor.

Investigators said the Department of Families and Children Services received a tip and went to the home to investigate.

They contacted the Sheriff’s Office to assist.

Once they arrived at the home, investigators said, Alina Dyzuba would not let them come inside.

They only gained entry once Lev Dzyuba returned home from work. That is when the investigators were able to speak with the children.

“When a 15-year-old child is secured in a room and he can’t get out of the room without somebody letting him out, and he’s kept in the house and unable to go outside of the house, things of that nature is what makes it criminal,” said Traylor.

Investigators said the alleged abuse was subtle and much more mental than physical.

“It has to just completely separate them from all of their peers and just be a huge impact on them to pull them out of the socialization with their friends,” said neighbor Andrew Covington.

Deputies said the treatment began about a year ago when the children’s mother passed away.

According to jail records, the father is accused of depriving the children of necessary sustenance, and his sisters are accused of causing the children excessive physical or mental pain.

The adults were taken to jail, and the children were taken into custody by DFACS.

“Prayerfully, we hope they’re in the right place with the right people,” said Morris.”

“The United States has confirmed that three people were arrested on suspicion of cruelty to their adopted Ukrainian children, a Ukrainian Foreign Ministry spokesman said Tuesday.

US media reported earlier this week that Lev Dzyuba, 37, and his sisters 20-year-old Alina Dzyuba and 26-year-old Natalia Mellon, had been arrested and charged with child cruelty and false imprisonment in Rockdale County, Georgia.

Dzyuba is an ordinary Ukrainian last name, but it was not immediately clear whether the suspect did in fact have Ukrainian ancestry.

“The US side has confirmed the arrest of Lev Dzyuba and his sisters. … It’s now up to the court to decide whether their actions constitute a crime,” said Yevhen Perebyinis, director of the information policy department at the Ukrainian Foreign Ministry.

“The adopted children have been taken into protective custody by Georgian social services,” he said, adding that the children had no physical injuries and their lives were not in danger.

A Ukrainian Embassy employee will reportedly travel to Georgia to give an assessment of the children’s health and living conditions.

A family member of Lev Dzyuba, Lacya Kucheryavaya, told television channel Fox 5 that Dzyuba and his wife had adopted three Ukrainian children a year ago. Shortly afterward, Dzyuba’s wife died of cancer, and his two sisters took care of the children and homeschooled them.

According to media reports, the children – two boys and a girl – were deprived of food and the ability to leave their rooms. Kucheryavaya said the accusations were a big misunderstanding because “Lev would not do anything out of the ordinary or extreme.””

The sisters, Alina Dzyuba and Natalia Mellon, had bond set at “$280,000 each” At the time of this August hearing, no bond was set for Lev.

A search of Rockdale County Georgia inmates, shows that Lev was booked on August 14,2013 and was released on August 27, 2013. Lev was charged with 3 counts of “CRUELTY TO CHILDREN-CRIMINAL NEGLIGENCE/CAUSES EXCESSIVE PHYSICAL/MENTAL PAIN – 2ND DEGREE” and 1 count of “false imprisonment.”

 

A search of Rockdale County Georgia inmates, shows that  both Alina  and Natalia were booked on August 14,2013 and was released on August 20, 2013. They have the same 4 counts as Lev.

Such a lie, Lev would NEVER hurt anyone especially those kids, my family knows him personally, in fact my mom used to cook for a kids through all this year, she can’t now, but I know that every Sunday they were seen in church… This is a very shaky story , the kids are a disaster they even got kicked out of school, so I know they were problematic, who whether did this to this wonderful person Lev and his sister will pay a high price. Justice will be served, and again no way Lev did anything to those kids…

    • Diana, as you probably have figured out, we moderate comments here, so your second one calling us names will not be published. He was arrested. That is what we have reported. You will not find much comraderie here for condemning the children.Older adopted children having problems? Whose responsibility is it to help the children? Why did they adopt …did they not expect issues? and why did an agency approve a woman who was dying of cancer? Unprepared people do not have the right to hurt children. It is no excuse.

      • Rally, I’m a lawyer who made their adoption in Ukraine. You know nothing about this family to judge anybody. I know everything!!! From the beginning till today!!! If you have not answers to your questions then please don’t public your questions. Larisa Dzyuba was NOT dying of cancer when she was approved to adopd. She was healthy and the question now is what caused her cnacer????? How do you think??? Unprepared people????? Do you have the proof that they were unprepared???? No. Then stop judging!!! Because one day you may be judged. Nobody hurt those children and please read news with very much attention!!!! What kind of hurt was proved?????? it is all a misunderstanding of what could happen in this life. Again, I did this adoption in 2010 in Ukraine and I know the reality. Stop it!!!! The previous commenter said that the adoption was a “disaster”. Why exactly was that? Where was the postplacement support for the children? Did you give support to them? And NO I will not be locking up my children, so I will not be in his position some day.

Rally apparently reading is your problem, I said kids were a disaster, meaning they are and were problematic kids and I won’t be surprised if they–the kids decided to go bizarre wih their parents and did all this mess to Innocent Lev. Also, I would like to ask you a favor about this case. Please watch this case and after this will resolve I know it will, apologize on your website and clear this families names, I’m asking you to do that bc I know newspapers won’t ever do that, they rather write their own stories to make sure it sells.
    It’s easy to judge not knowing the facts and people. And it happen that I know Lev and he would never do this! We are talking about a family that really doesn’t deserve all this and I know will know the answers soon and whoever did this hopefully will pay a high price.

If you read anything on this site you would know that.I don’t apologize for stating FACTS like they were arrested nor for questions because the questions are about the welfare of the children.     just one fact for you, did your kids ever wrote you letters saying they will kill you, or they killed your wife??!!?? got kicked off from school in a short period of time. School Principal said he never met any kids with such behaviors?!!?!?! Well you see what I mean by Problematic kids… Continue he didn’t lock them for that no, but knowing this, do you consider kids are smart enough to say things about him to get him locked! Yes!! Can kids do such things !!! Of course !!! They can be angels and visa versa !!! And some know the system better than you and I!!!

    • Diana, you are speaking to adoptive parents who have children with varying special needs. Did you know that the authors of this blog are ADOPTIVE parents? You did not bother to look at that.You should peruse the archive to see how many children are abused by adoptive parents. Locking children up no matter what their behavior is wrong.Humanity and common sense is lacking in this world and in all of your responses. Postplacement support and good decision making was necessary here including disrupting the children. Thank God these children are still alive as we have so many cases where the child ends up dead from the starvation. Just look at the Hana Williams case.

Ukraine already is very upset with US adoptive parents since they do not send in the REQUIRED postplacement reports NOR does Ukraine get notified by the US government in a timely manner about abuse and death cases of Ukrainian adoptees who are dual citizens. Any of these cases may put the final nail in the coffin of Ukraine adoptions to the US.

I think you believe in God, since you have this website, the reason i think so is cause you believe in right or wrong — which results thats Godly ideas (as I do too)… also im assuming you read Bible as I do to, where it says do not judge (and trust me I do judge people in my heart too but i realize that and ask everyday for forgives that s the point of trying to be closer to God) so here is my question, Whats up with the “hall of shame”” are you like Gods helper or Gods told you to help him out here or what allowes you publicly to post lets say about Lev I know for sure that was your bad.???

    • Ah yes, the Do Not judge Bible quote. I think there are some quotes in there about justice and some Commandments in there too.And something about doing what is Right not popular. We are here to bring awareness to ALL things that need to be changed in the modern adoption and child welfare system. This column shows the LARGE quantity of abused adopted and foster children because no one cares. When no one cares, no changes will be made. We explained already that homestudy and postplacement changes could have prevented this case. I am not afraid of telling the TRUTH. I believe God is on the side of TRUTH. I can’t explain any further how locking up children (which you admit he has done) is wrong. I can’t fix stupid nor does God ask me to fix stupid.

  7. My common sense is fine, and I never said he locked the kids, because I know he didn’t do it. I know he got arrested and I know that is a mistake, it will resolve. And I am glad you adopted kids good luck to you. And I don’t wanna spent my time reading about your life on your website etc.
    I wrote here to defend Lev because I know he was wrongfully accused.
    And I don’t see a point writing to you anymore as I should of known YOU wouldn’t understand based on your replies!
    I honestly feel sorry for you! I’m not bashing the kids in saying facts that I know the truth as you said but obviously YoU show no interest… You are just another website that seeks publicity no matter what the truth is and don’t say other wise.

    Of course I went to the police and FDFCS and submitted my statements, don’t worry, I know what to do, I’m a lawyer. As well as did many other people who know the real situation, who know children and who know Lev Dzyuba and knew his wife. And that’s why the case will turn soon. And of course you can ask questions publically, just ask the right questions, not wrong. And please don’t make wrong own conclusions. Write the facts or what was published by the authorities. I don’t think the authorities stated that Larisa Dzyuba had cancer when she was adopting. So, please be correct with your expressions. About abuse of adopted children. Oh, yeah, there is a lot of abuse in this world, of biological as well adopted children; of adults too. A lot of abuse. But, in this specific case, these children has NEVER been abused by their adoptive parent/s and/or other relatives in the USA. This case IS NOT ABOUT ADOPTION ABUSE. For you, as adoptive parent, to know: the Dzyubas did postplacement; they did the therapy and everything possible for these children. These children were not locked up in their rooms!!!! Everything Lev did — was done to protect his children from themselves and from other people. These children are very dangerous and the corresponding actions should be taken and will be taken! For safety of thsese children!! I am not entitled to tell you their whole story starting from their bio family. I only want to tell you that all parents (biological or adoptive) should not abuse their children and should not abuse other people, and that is what you should keep your blog about. And …about closing adoption from Ukraine to the USA. You absolutely don’t know what are you talking about. It is about politics, not about children, it was never about children and will never be about children. Governments like to manipulate with orphans, like in Russia, so don’t hope about a nail on a coffin.

    • Natalia, if you went to the police, then there is nothing for you to worry about then. I should ask the *right* questions? What does that mean? I asked the question about the cancer and homestudy because it was not stated in the article and with the high number of waivers these days, I would not be surprised if she did have terminal cancer and was allowed to adopt.The homestudy process is a joke. There are waivers for age, medical conditions of adoptive parents, number of children in the home, number of children being adopted simultaneously and income. This CASE is about adoption abuse as they have been arrested for that reason. We record all cases published in the media and update all cases as we get information. Lev does not get special treatment.

      Stop putting words in my mouth about countries closing down. I didn’t say that I “hoped” it would close. I warned that it is going to happen because of the paltry number of postplacement reports coming in. Why do you think that a country shouldn’t know about the welfare of its citizens? And you obviously have not followed all of the abuse cases from Russia adoptive parents in the US ,the lack of sentencing in most cases, and the last 3 years of statements that Russia has made with regard to the US not following their requests.It was not a shock that Russia closed when the US did not follow the treaty they signed.

      What was this “everything” which Lev Dzyuba and his sisters did, if the police charges that they locked the kids in their rooms is false?

      If these children in fact posed a threat to self and others, did the Dzyuba siblings seek mental health services from qualified professionals for them? If they didn’t, that would constitute medical neglect. Also a lack of Postplacement services and monitoring from the adoption agency, which shows a need for reform in this area.

      How long after the adoption was finalized was Larisa Dzyuba’s cancer diagnosed, and how long after that did she die? Usually chemo can buy cancer victims at least a few years of remission before it recurs. That makes her death from cancer “shortly” after adopting three kids unusual. The timeline makes it appear that either Larisa Dzyuba passed a health screen for international adoption that DIDN’T catch that she was ill with terminal cancer OR that she was in remission from a previous diagnosis of cancer, and thus should NEVER have been approved for adoption. Either way, it shows a heinously inadequate homestudy, and thus a need for reform.

      Just so you know, this site’s ‘Hall of Shame’ includes news coverage about adoptees who murder their adoptive/foster parents– or anyone else– and even cases in which an adoptee is the victim of a crime committed by someone outside their adoptive family. The ‘Hall of Shame’ is extremely comprehensive.

      • There are many kinds of cancer that are hard to detect in early stages (read: by the time you have symptoms, its basically terminal) and thus fatal within mere weeks/months — including pancreatic and DIPG (brain stem) cancer.

If you want to help “correct” his record, then share some information about how the children lived in the house. If you don’t want to share, then shut your traps.

  11. For those of you that know Lev, Please do not give anymore details as far as this case is concerned. It is an on-going open investigation. Any information can be used against you, whether it is accurate or not, and whether it’s by a subpoena or just internet trolls. If you have any useful information, take it to the Sheriff’s Office or the courts. So let’s wait for the trial date and not jump to any conclusions. But I must say, after reading the story from many of the news stations, they all do seem to attack Lev and demonize him without a fair trial. Let’s have a little faith in the constitutional 6th amendment and give him his fair trial. If the children were indeed treated so poorly then it will be brought to light… Otherwise, Not-Guilty. Well, that’s my two cents! : )

  12. After reading this info, that as an American I was taught that your innocent until proven guilty. I have lived in the Ukraine and been around Ukraine kids and how wild they run and act uncontrollable in the hall ways at school. Until all the fact are told I would suggest being fair and BALANCED about your objective comments. If you weren’t there than don’t take here say and make it into some more than it is. Do you know for a fact the kids were correct for their age ? Do you know if they did or didn’t get along with all people. I read many of the comments left by even attorney’s that stated more correct fact than did you. Also many in today society RUSH TO JUDGEMENT about everything, before getting info. Isn’t it funny how many people make problems and should be sued for not minding their own business. Life or death reason to inquire is not bad, don’t get me wrong here. But nothing to say or are you answers why the kids were KICKED out of school Did you do any investigations about that because or before making or coming to an conclusion? It not our duty to judge as our Lord has said not to do. DO you know all the situation about everything ? I doubt it much that you do.

    Until you know more facts don’t rush to judgement like all the media does. It the media mostly that blows things way out of the truth. Its what is wrong with our country every body out for a story to sell to make money on. Let the legal system do it job not you and the media try, sentence and convict before he even has a trail .. come on this is America not BS sites like this.. Let the public and his peers say after the proof he did or didn’t do as you all make them out to be.
    My wife is from the Ukraine and so are 2 of her children and my step kids and i have also 2 of my own from her. So don’t judge other yet. Its our Lord who will judge you, worry about your own action before God not your comment toward others. you should be ashamed of your self.. or look in the mirror who you are first before judging others. Not guilty for Lev until such proof say so. If I was Lev i would ask to clear my name by taking a lie detector test. And sure give those kids one also. I bet even there stories don’t match up either.

    • Ronny, Sigh! you don’t know how to read either. We have reported that he was arrested and that he still is in jail. That is *confirmed*. The innocent until guilty is in regards to the courts.We already stated that we are not the courts. As an American, we can ask questions and even GASP! have opinions and we don;t need to agree with you. We have NOT said that he was convicted and we will continue to update the case as we get information.

      We don’t make money on anything here, so don’t bring up that stupid strawman. Don’t you dare tell me what I can and can’t blog about.Continued harrassing comments will be forwarded to MY lawyer.

      And Ukraine will be investigating this also, as I reported. That also is the truth. Something apparently you can’t handle. So sad that no “friend” of Lev cares about the welfare of the children.Not ONE comment has been made that shows that ANY of you care about the children AT ALL. So sad !

  13. These are children for crying out loud! they are also orphans. They have no one to speak up for them, where as Lev has the half the church that are somehow related to him that have his back, and if you want to talk about God so much, God also says that i Will protect orphans and widows myself. Where is the heart in this. Children already as it is have no voice. I am proud of our government for taking action and investigating every call that comes in about abuse. I hate to say it but you never now what someone is capable of. My heart goes out to these children because they are all alone in this world. they have no support from anyone, its their word against half the church which may i mention are their relatives.

  15. Just one question…if everyone that commented was such a supporter, where did the “justice for Dzyubas” fb site go? Why are you all “christian” people arguing on a website? You don’t have anything better to do than to prove something to the Rally who has the right to post whatever they want…we live in a free country and Rally is allowed to post this story as it was in the AJC and the news. Instead of getting these people lawyers and such, you sit in a blog arguing…. You bring up bible versus? like for real? If you people are christian…you wouldnt need to keep bringing up God into every conversation to argue…its like throwing out a racist card when you can’t win on your own. You dont need to always agree with what people say or do, that is your personal option…dont intimidate others with the words of God..he gave you a voice, legs and arms..so go do something if you strongly agree that these people are innocent!
