From Churchdown, UK, “A delivery driver had sex with a [foster] girl despite being told she was just 13, a court heard.
Davinder Singh, 29, met the girl, who cannot be named for legal reasons, last May on a dating site called Evow.
The pair began a sexual relationship on the same day they had began talking on the dating site, with the two having sex in his van, her home and his home over the next week.
After two days of seeing each other, they both put that they were in a relationship on Facebook on May 19, which is when Singh was informed of her age.
A friend messaged him stating that he was in a relationship with a 13-year-old and Singh immediately took action.
Confronting her about her age that day, she soon admitted to being 13, and not 18 as she had earlier told Singh.
Despite this, the girl ran away with Singh later that week, and even agreed to move in with him after the pair looked at houses.
After nine days of seeing each other, Singh, of Churchdown, Glos, was found by police in a friend’s van on May 25 while attempting to get clothes for the girl from her sister.
Appearing at Taunton Crown Court, Singh needed a translator and is accused of six counts of sex with an underage person, and one count of child abduction between the May 16th and 26th.
While he admits having sex with the girl, he denies the allegations and claims she reassured him she was 18.
Prosecuting, David Sapiecha said: “The case is about having sexual intercourse with a girl of 13.
“It’s not a case where the prosecution say she wasn’t consenting – she was.
“But adults take responsibility in such circumstances and should not have sex with a 13-year-old girls.
“This was not a man meeting a lady or a woman at her house or a pub. There was no going to her house immediately.
“Afterwards they both went back to her foster home where they had to sneak in because of her foster parents.
“They went to her bedroom and had sex again.”
The pair met up again on Sunday, Monday and Wednesday, before running away to his house on May 22.
The girl had left a note for her foster parents where she said she ‘sorry’ to put her foster parents though this, ‘I’m happy’, and that ‘when I’m 16 we will get married’.
The girl was under the care of Somerset Social Service, and was living with foster parents on the Mendips around 55 miles from the defendant.
She had been given an internet ban due to the nature of her foster care, but managed to get online through a Nintendo Wii, which she connected to her foster parent’s wifi without their knowledge.
Her internet access had been restricted to stop her coming into contact with older men but she found a way around it, meeting Singh online before meeting him for sex the same day.
Their relationship progressed quickly and on May 22 she ran away with him to his home, with the pair planning on getting their own place.
The court was showed a DVD of a police interview with the girl from November last year, where she explained that at one point Singh discovered her age but they continued to see each other.
She said: “Monday night he found out I was 13. A friend sent him a message [on] Facebook.”
When asked what it said, she said: “’You do know your girlfriend is only 13?’
“That was sent to his Facebook.
“It said on my Facebook I was in a relationship with him.
“He emailed me straight away asking me and I said ‘yeah’. He said ‘I need to see you ASAP to talk about it’.”
When the pair met up, she explained: “He just said I was sexy for a 13-year-old.
“He just said he would get in a lot of trouble for doing this.”
