From Vienna, Ohio, foster mother Diane Ervin,also known as Diane Benson,”pleaded not guilty Tuesday[November 18,2014] to a charge of child endangering and felonious assault. A grand jury indictment accuses her of breaking the leg of a child under her care.”
She “posted $50,000 bond to ensure her release until a pre-trial scheduled for Dec. 9 before Trumbull County Common Pleas Judge Andrew Logan.
The injury was discovered Sept. 11 during a visit to a pediatrician. The infant male was born July 2. The court record didn’t state when the child was placed with Ervin.
Besides Vienna police, investigators with Ashtabula County Children Services investigated the case.”

“A Vienna woman accused of breaking a child’s leg while in her foster care is found guilty.
Diane Ervin was found guilty of child endangering, however she was not found guilty of an additional charge of felonious assault.
In September 2014 the child was discovered to have a broken leg after a visit to a pediatrician.
Ervin is scheduled to be sentenced on June 22nd.
Ervin originally pleaded not guilty to the two charges. ”

Update:“A judge sentenced a foster mother from Vienna Township Tuesday after a jury found her guilty of child endangerment earlier in June.
A judge sentenced Diane Ervin to two years in state prison, with credit for time already served. Ervin will have to pay for her court costs.
The child’s pediatrician reported in September that the two-month-old child in Ervin’s care had a broken leg. A jury found Ervin not guilty of felonious assault but guilty of child endangerment.”
