From Tacoma, Washington, foster father Dwayne Desmone Mitchell, 25, is “accused of choking a 13-year-old foster child in his care won’t serve any more time in jail.”
He “pleaded guilty earlier this year to fourth-degree assault and was sentenced Thursday to one day in jail. Because he was given credit for the day he spent in jail after his arrest, he won’t serve further time behind bars.
Mitchell initially was charged with second-degree child assault, but Pierce County prosecutors agreed to reduce the charge as part of a plea agreement.
Police got a report of the assault in July 2015, after the boy and his two brothers had moved out of Mitchell’s home.
The 13-year-old told police Mitchell had slammed him against a wall and choked him, allegations the boy’s brothers confirmed, according to charging papers.
According to a parenting assessment filed with the court in January:
Mitchell had known the boys since they were born, knew they’d had a troubled home life and agreed to care for them.
On the day of the assault, Mitchell said, one of the brothers said the 13-year-old had choked him, and Mitchell became upset. He said he picked up the 13-year-old under his arms, held him against the wall and scolded him for hurting his brother.
The report, in which Mitchell denies the choking allegation, evaluated his interactions with his own children, and found he showed signs of “seasoned parenting.”
“He is attached to his children and wants the best possible outcome for them in life,” the report said.”
