“A Helena-area man who said his former foster mother repeatedly raped him as a teen is suing the state of Montana for placing him in her home.

The lawsuit filed in Lewis and Clark County District Court Wednesday accuses the state of Montana and its Department of Public Health and Human Services of negligence and negligent supervision.

Court documents state the teen resided in the foster home from November 2014 to May 2015 and allege he was “repeatedly raped and emotionally abused as a result of the negligent and reckless foster home placement.”

The documents also allege the state failed to supervise, screen and monitor the care the teen was receiving in the home.

“Plaintiff’s severe emotional distress was a reasonably foreseeable consequence of Defendants’ negligent acts and/or omissions,” the lawsuit says.

The man is asking for an unspecified amount of damages for emotional distress, physical ailments and medical expenses for therapy and other harms. He also is asking for a jury trial.

The man’s foster mother has been charged with felony sexual intercourse without consent, and her criminal case is pending. To protect the plaintiff’s identity, the Independent Record has chosen not to name the woman in this story.”
