From Warren, Ohio, emergency foster care giver, Amber McElravy “pleaded guilty, after a viral social media video alleged she abused a 5-year-old boy, was sentenced to 12 months in the Trumbull County jail.
Amber Rae McElravy, 27, of Scott Street, pleaded guilty in March to the amended indictment of four counts of third-degree felony child endangering charges. She was not the biological mother of the child, but he was under her care at the time of the incident.
Before Trumbull County Common Pleas Judge Andrew D. Logan handed down sentencing, McElravy asked to address the courtroom.
“I would like to apologize and take full responsibility for my actions,” she said. “If I could, I would go back and change what happened.”
Her defense attorney, Roger R. Bauer, hoped to have his client get probation. He said she has since separated from her husband, Kyle McElravy, who was also arrested on charges of child endangering along with domestic violence after the video surfaced, allegedly showing him abusing the same child. Kyle McElravy will appear in the same courtroom next Tuesday for a pre-trial hearing.
The two have since filed for a divorce, court records show.
Trumbull County Assistant Prosecutor Gabe Wildman took issue with a statement made by the defense when Bauer insisted that the child suffered mental harm, not physical abuse.
Wildman stood firm in his belief that the case necessitated a prison sentence, to which Logan agreed, deciding against granting any type of probation.
Evidence in the case, according to a Trumbull County sheriff’s report, came from a witness who called from Girard saying she sent authorities a video of a child 3 to 4 years old being hit many times ä including being struck with a belt and also being thrown around the room. The report states the family at the address in the 5200 block of Scott Street had been reported several times previously on abuse allegations.
A report stated the boy has been sent through Trumbull County Children Services for emergency foster care. A report showed the child had no visible injuries but the abuse had been going on over a month’s time.
Amber McElravy was arrested last September at the Scott Street home and booked into the jail. Other children in the house were sent to stay with a paternal grandmother, while children services went to the Newton Falls house to secure the boy.”
