How Could You? Hall of Shame-Louis A. Martinez aka David Louis aka David Barber UPDATED

This will be an archive of heinous actions by those involved in child welfare, foster care and adoption. We forewarn you that these are deeply disturbing stories that may involve sex abuse, murder, kidnapping and other horrendous actions.

From Honolulu, Hawaii, Heart Gallery Hawaii  founder, “Everyday Hero” , and PAP or AP Louis A. Martinez aka David Louis aka David Barber,37, “is charged with counts of felony sexual assault and felony attempted sexual assault plus counts of misdemeanor sexual assault.

Martinez was indicted last week and arrested May 31. He’s in custody at Oahu Community Correctional Center with bail set at $150,000.

He was arraigned Thursday and pleaded not guilty.

Prosecutors say Martinez also goes by the names David Barber and David Louis. They say Martinez in October 2011 gave liquor to a 16-year-old girl and assaulted her as she slept.

Martinez in 2005 using the name David Louis, opened now-defunct Heart Gallery Hawaii, an organization that encouraged people to adopt hard-to-place foster children.”

As of this posting, his picture is still on the Hawaii page of Heart Gallery of America, inc. which states that he aged out of foster care and that he was in the process of adopting a teen. It is currently unknown if that adoption has taken place.

This article talks about the photo shoots of the Heart Gallery. I think I just vomit.

2009 Media

“David Louis, founder and executive director of Heart Gallery Hawaii, has been named executive director of Heart Gallery of America Inc.

Heart Galleries across the country raise public awareness of the need for adoptive families and help find permanent families for children.

While continuing to run Heart Gallery Hawaii, Louis will oversee daily operations and the Web site of Heart Gallery of America, plan its national convention in August, facilitate its monthly board meetings and engage sponsors and others to support HGA’s national efforts.

Louis, 32, was born in Los Angeles where he graduated from Boys Republic High and attended Mt. San Antonio College. Before founding Heart Gallery Hawaii, he worked as a counselor, therapeutic aide, psychiatric assistant and mentor with such groups as The Queen’s Medical Center, Nursefinders, Manawa Lea, Kahi Mohala and the state Department of Education.  I think I just vomit again.

What brought me to Hawaii: I grew up as an orphan and had no roots. I drove across the country when I turned 18 and, in all honesty, the thought of the warm breezes, swaying palm trees and beautiful women in Hawaii enticed me.

Why I took this job: I saw that there was a desperate need on behalf of the children to spread the word about the need to help them. I started Heart Gallery Hawaii with the mission to make the needs of these children known, and to help each child directly on a case-by-case basis.

Like most about the job: I get to be with the young people — from going to Sea Life Park to Kualoa Ranch to the park to play basketball. I get to help these children, who come from often horrendous situations, smile and laugh.

Like least about the job: Taking them back to their placement after a visit. I wish I could adopt all of them. Also knowing that they have to wait for a family or may never get a family, that weighs heavy on my heart.

Immediate priority: The next event: a dinner with Chef Roy Yamaguchi for 30 foster youth hosted by the world-renowned chef.

Long-term challenge: Keeping these children out of the shadows. Giving the next generation hope — even as I watch some 100 children turn 18 every year in Hawaii without having found a family to adopt them.

Strategy to overcome the challenge: Smile, stay positive and work hard on new collaborations to help the children.

Biggest challenges in my industry: Money. There is very little (even without the current financial crisis) for all the aspects of foster care — the workers, the foster parents, the things for the young people that might make them feel a little more “normal.”

Five-year vision: To safely reduce the number of children needing foster care by 20 percent through education, prevention and adoption.

Essential business philosophy: Of course we can.

Biggest risk/smartest move taken in my career: I needed an immense amount of time to start the Heart Gallery so I quit my job and stayed home to work out all the logistics. Footing the bills initially, my wife and I poured every extra cent into events, brochures, banners and travel expenses so that Heart Gallery could get a foothold in Hawaii.

What I value in my employees: A positive attitude and willingness to help however possible.

Most important lesson learned: Always put the children first; everything else will follow.

Most overrated secret to success: For me, competitiveness. Instead, when I joined the community of leaders and directors who work in foster care, I sought to find out what their services were and see how Heart Gallery could highlight or enhance those services.

Most overlooked secret to success: Google — lol! Every time I need to get info on a state policy, nonprofit procedure or any other aspect of how to grow Heart Gallery I Google and find the answer. Also, listen to everyone — there is always something to learn.

I’m inspired by: Diane Granito, founder of the first Heart Gallery in New Mexico. On a whim she aggressively sought out ways to make her Heart Gallery a reality.

One rule I live by: Do unto others.

Favorite stress reducer: Lifting weights.

Favorite way to spend free time: Outings with my family.

Book by my bedside: The Bible.”

REFORM Puzzle Piece

I have FacePalmed these “heart” foster care recruitment operations that are in many states multiple times due to the programs throwing privacy and dignity of these children out the window and now I can add poor screening of people involved in the operations . Heart galleries with photos have been displayed in public libraries, children’s museums and even Taco Bells!

Update: “An adoption advocate has been jailed at Oahu Community Correctional Center on child sex-assault charges, including allegedly giving a 16-year-old girl hard liquor and then assaulting her after she fell asleep.

Louis Martinez is the former executive director of an organization that encourages adoption of foster children. He was charged earlier this month of attempted sexual assault involving a girl who was 11 years old in 2011. Last year, he was charged with sexually assaulting a 16-year-old girl, allegedly in her sleep after he gave her three to five shots of hard liquor, Deputy Prosecutor Chastity Imamura told a judge last year. She said the teenager was suicidal because of the alleged assault and has received psychological treatment.

Martinez was extradited to Honolulu from the mainland earlier this year after he fled while on supervised release, Deputy Prosecutor Lisa De Mello said.

He couldn’t be reached at the jail, where he’s being held on $400,000 bail. He has pleaded not guilty. His public defender couldn’t immediately be reached for comment Monday

Using the name David Louis, Martinez, 38, opened Heart Gallery Hawaii in 2005 and then became executive director of Florida-based Heart Gallery of America in 2009, the Honolulu Star-Advertiser reported. The organization encourages people to adopt foster children by taking photos of the children and displaying them publicly. The Hawaii chapter is no longer operating.

He released a book he wrote in 2006 titled, “Scars That Can Heal,” about his experiences growing up in foster care on the mainland.”

Update 2: “A Hawaii jury has convicted an adoption advocate of sexually assaulting two girls.

Jurors deliberated for less than three hours Friday before finding Louis Martinez guilty, the Honolulu Star-Advertiser ( http://ow.ly/HukUv ) reported.

He was charged last year of attempted sexual assault involving a girl who was 11 years old in 2011. In 2013, he was charged with sexually assaulting a 16-year-old girl. Prosecutors say he assaulted her in her sleep after he gave her three to five shots of hard liquor.

Martinez is the former executive director of an organization that encourages adoption of foster children. Under the name David Louis in 2005, Martinez opened Heart Gallery Hawaii, the local chapter of a national organization that recruits parents for hard-to-adopt foster children by taking photos of the children and displaying them publicly. The Hawaii chapter is no longer operating.

Martinez was extradited to Honolulu from the mainland last year after he fled while on supervised release. He left Hawaii without the court’s permission while on release under the supervision of an elderly couple who had adopted him as an adult.

He used the name David Louis in 2006 when he released a book he authored about his experience growing up in foster care in California. “Scars That Can Heal” chronicles getting placed in foster homes 30 times and changing schools 19 times.”

Hawaii Jury Convicts Adoption Advocate of Girls’ Sex Assault[ABC News 1/17/15 by Associated Press]

Update 3:According to  Hawaii’s court records ,Louis filed for mistrial in 2015. His request was finally denied on 4/1/16. His Sentencing will be on 6/14/16.

Update 4:“The founder of a former Hawaii organization that encouraged the adoption of foster children has been sentenced to 30 years in prison for sexually assaulting two girls.

The Honolulu prosecuting attorney’s office says a judge sentenced Louis Martinez on Tuesday.

A jury found him guilty last year after deliberating for less than three hours.

The girls were 11 and 16 at the time of the assaults in 2011.

Prosecutors say he assaulted the older girl in her sleep after giving her hard liquor.”

  1. I hope nothing like this happens to you. Having your name run through the dirt. When this case is over you will feel dumb running your mouth. The system is flawed, but this is one of the few people that help make it better.

  2. You’re quick to judge, without knowing the both side. I’m 100% against molestation. But I know the whole / both stories. Half of the girls family doesn’t believe her.

    • We are not the judge here. We list cases and post updates. We are not on the jury either. So nice that you blame the victim so quickly. We get that a lot here.

  3. Tony, it is very common to cast blame on a rape victim. This is the wrong blog for that.

I agree with Rally. These photo listing websites are a gross ethical violation. There are too many people who get a paycheck as an executive director and grant funding when there are other ways of finding homes for these children.

How much money does it really take to operate a Heart website? The professional photographer donates the time and talent, a template website gets the photos online and these kids have their whole life story on the web. It’s also a duplication of what many state child welfare departments are already doing.

It used to be, kids that were hard to place, you went to the agency office AFTER a home study, training, screening and other safeguards were done. Then if you were suitable for that child, a trained and experienced social worker did the matching. Special Needs adoption is NOT a do-it-yourself project.

I’d rather see this grant money going directly to the children, not lining the pockets of someone like the guy profiled here.

Exploiting grant money for programs with marginal outcomes and putting kids at risk is not helpful

    • You guys make me laugh. You have very little knowledge on the matter, but assume the worst. And everyone is an expert of how the system works. I’ve experienced it first hand. The system could care less long as a kids in a home. I lived in 9 different homes before I was 8. Beaten and neglected, sexually assaulted in 8 out of the 9 homes. Pretty bad odds for a child. So running a heart gallery and helping kids get placed sounds awesome to me. Most social workers I’ve dealt with are lazy. Even to this day. I work in a hospital and see unfit Foster parents. People looking for an easy payday. But people always look to bring down the people who really do make a difference.

      • You have no idea what our backgrounds are. We report on any abuse or death case in the media and will update this case as needed.

        • So, Rally. where is the update on this case? It’s almost late October,in what happened? Is he out? Is he in prison? Please l
          let us know.

  4. See Important Update for Readers on the homepage about Rally.

According to court records the trial is set for November 18, 2013.

  5. The case has been set over to late February. Unfortunately, the judge in this case allowed the offender to be let out on supervised release. His whereabouts are now unknown as he has left the home he was remanded to. Sadly, another victim has come forward and I hope they find this guy fast before there are more.

  6. A photograph of this alleged perpetrator can be found at this site: https://www.vinelink.com/vinelink/initMap.do. Offender ID No.A6037927.

  7. Yes, he is on the run. There is an extraditable warrant from the State of Hawaii. Federal Marshalls are also involved. Anyone seeing him should call 808-478-8716.The feds think he’s holed up on the island of Oahu, but could show up in California or Vegas. Check the photo and send it to anyone in Hawaii who is sympathetic to victims. The most recent was assaulted when she was only 11 years old and has come forward with similar allegations as the first. There may be more…Let’s do all we can to prevent future assaults and get this guy back where he belongs. Thanks.

  8. Facts are off by about 4 years. The case actually would have been over in February. But when his wife found out there was no evidence to convict him she decided to take her daughter down and claim the same stuff. But. Said 4 years ago it happened. Why didn’t she go to police 4yrs ago? Sorry but his wife and her family set him up. And if he was a threat why did judge let him out without even having to post any type of bail? Now a month and a half later their looking for him? 6weeks later you can be anywhere in the world. Only victim here is Louis. Lost his kids because his wife couldn’t just divorce him like a normal person.

  9. I think when people post to this forum, they should be careful to be accurate. Since the post of “Tony” on January 12, I have carefully researched both cases. “Tony” is in error that the alleged incident on the alleged perpetrator’s own daughter occurred “4 years ago” because the police report states the incident occurred only a short time before the alleged assault on the 16-year old girl in the Hawaii case; therefore in the summer of 2011, not “four years ago.” Anyone posting here should be factual, respectful and not maliciously attack the motives of victims, whether adult or child. (A worthy task for the moderator of this forum). This type of incendiary dialog only pushes victims further underground, as they do not think anyone will believe them if they come forward, as was the case with the second victim. Posted below is a well- researched unbiased article that serious persons can review, and provides the proper way to fight a case of false accusation. The facts show that children rarely lie about sexual abuse incidents, and unfortunately, child molesters rarely confess. How sad it would have been for “Tony” if no one had believed the sexual and physical abuse he allegedly suffered as a foster youth as mentioned in his post of July 19. “Innocent” people should step up and defend their “innocence,” if indeed it exists, and not run from the law. Evading arrest only fuels the notion that the allegations are true, not false. As of this writing, the alleged perpetrator, called “victim” by “Tony”, is still at large. http://en.wikipedia.org/wiki/False_allegation_of_child_sexual_abuse

  10. I don’t know where you received your information freedom fighter. But as I said earlier, I actually am not looking up information. I know the parties involved in these cases personally. I still have contact and know the whole story and heard them as they supposedly happened. Like your Wikipedia link says. Only small percent are innocent. And are brought on by an adult. Like this case. Louis is only on the run because his wife got him kicked out of the house approved by the state. With these types of charges I wouldn’t want a public defender either. With his house sponsors gone he could no longer pay his lawyer and would have to go back to jail without a fair chance to defend himself. Hopefully when his daughter gets older and puts everything together she will clear her case up. And for his niece I hope karma comes full circle.

    • I personally know Dave too and everything that’s happening to him is totally screwed up he is being set up by his own wife he is a very righteous man who the state is trying to convict on false allegations of sex abuse it’s a sad day in paradise and in every corner of the globe when good people suffer at the hands of selfish evil doers if there is no physical evidence whatsoever let the man go child protective services investigated the case early on and found him not guilty then our all self important state prosecutors decided to pick up the charges and at time of trial will coach alleged victim to cry on the stand on cue and then Dave will be done it always happens his own lawyer who was the states prosecuting attorney and protege of high profile cases state attorney Gary modafferi said he coached dozens of similar cases and won because victim was made to cry on cue unbelievable how devious the states lawyers are well actually it is very believable these people are the scum of the earth not meaning to berate scum.

    • Hey Tony! I would like to speak to you. David was a friend of mine. I took part in Heart Gallery some years ago. He showed me around and I met his family, I just eventually lost touch with him. I know he used to call his wife “Dove” like I really been around I’m not making this up. My name is Jeremie. But you can add me on FB as Jerome McCall. I want to write David…he made a diff. in my life as I came through the system and I’d like to get in touch.

  11. Inside sources say he has been caught, just yesterday

  12. He is innocent till proven guilty

  13. I am disappointed by our system. The poor man is being set up by his wife. She wanted custody of her children. She got what she wanted. What a great way to destroy an innocents man life. A man that only wanted the love of her wife and children. She got her wish. Hope she’s happy. God will punish the guilty in the end.

  14. Wow “Name”! We never knew how deluded every Grand Jury and jury of peers have been in all the sexual abuse cases tried in our courts. In your “ideal world” victims would never speak out unless they had a blue dress with dried semen…like Monica Lewinsky….and jury members might as well stay home becaue all the victims cry on cue from their corrupt prosecution lawyers. Certainly a safer world for “righteous men” like the alleged perpetrator in this case…a world where victims maintain their silence with ruined innocence behind frozen smiles. Thank you for your insight to us “deluded” victim advocates. Where would we be without you and your “star witness” mentioned as an expert in your post and featured below in a most interesting article:

    http://www.staradvertiser.com/columnists/20101219_Lawyer_Modafferi_rebounds_from_dreadful_ice_addiction.html

  15. Wow Freedom Fighter, you sound like an expert on everything. You must live in a perfect bubble. But since you are such an expert on everything. Maybe you can enlighten me on why someone who is around kids all day everyday, for his whole adult life. Mess with his own family? Why has hasn’t he molested any of the thousands of kids he has helped? Seems like they would be an easier target. Who’s going to believe a troubled kid? But none of them have came out in 15 years. But in your eyes I guess it makes sense to go for the kids you will see the rest of your life in a house full of your family vs. A troubled kid that you could isolate and have no witnesses and never see again…..yeah that makes perfect sense. You must be the guy Dove is planning a new life with.

    • I currently know the family, the wife and children. She told me her story and it seemed suspicious. I am afraid that some of what Tony is saying could be right.

      • I feel dove is the most suspicious person that I have ever met. My gut feeling, my instincts and her careful calculated stories lead me to believe that she has motives to instigate this entire scenario.

        • Is this “Dove” the guy’s wife and/or ex-wife?

And if so, why is she even being brought up? Cops don’t arrest people– or district attorneys file charges– just on an aggrieved spouse’s word alone. They investigate– and only IF they find evidence of wrongdoing do they act.

IOW, both alleged victims must have verified the charges. Thus Dove’s credibility– or lack thereof– is a non-issue. She’s not the complainant.

    • Do you happen to know who David’s attorney is. I may have some information that may be helpful to David regarding the latest charge. I can’t be sure if this information will be helpful, but I want to pass it along and let them decide if it’s relevant to the case. Thanks

    • Jonathan Welch is Doves next pawn and victim, the man she plans to start a new life with.

  16. Tony,

Maybe he has– and none of them have come forward because they think “Who’s going to believe a troubled kid?”

    • Astrin Ymris, you’re so dramatic. If you truly had an open mind and an open heart you would understand that it’s possible to have a man that just might be innocent. One out of hundreds of thousands of men that maybe you can show some compassion to. I felt the way you do, but knowing someone so well and listening to both sides of the story you would see that he is innocent. If you TRULY knew the entire story you would know why Dove and her family has so much to do with this. They’re pro’s.

      • By the same token, if YOU truly had an open mind and an open heart, you would understand that it’s possible that David Barber/David Louis is guilty… no matter how charismatic he is, or how much you dislike Dove.

I’m not sure why you’re claiming that I’m not willing to accept that he might be innocent, though “flight to avoid prosecution” doesn’t seem like the act of an innocent man. I simply said that he was NOT being mistreated by the fact the police took the complainant’s allegations seriously, rather than waving them off,

However, he’ll have his day in court, and the jury will review all the evidence and weigh the credibility of all the parties involved. Then they’ll decide.

      • @not guilty. Do you happen to know who David’s attorney is. I may have some information that may be helpful to David regarding the latest charge. I can’t be sure if this information will be helpful, but I want to pass it along and let them decide if it’s relevant to the case. Thanks

    • How would you know I think this info is comming from Louis via outside contacts

  17. Actually found guilty on January 16, 2015. Hopefully, his victims will now have some peace.

  18. I read everyone’s comments and its crazy how everyone is judging David…i agree with Tony, can’t noone judge him if you weren’t there…so many people these days are lying about this kind of stuff and its sad cause the judges don’t give a damn or anyone else in the court system..anyone can go make a false report and the system just runs with it…even when it convicts an innocent person…and all you that are talking negative or putting David down can go straight to Hell…who are you to down grade him and you don’t know crap about the situation…i believe deep down in my heart that he’s innocent and he’s getting time for something that didn’t even happen…i believe the girl had a crush on him and he wouldn’t give her the time of day…so the only way to get back was to lie on him…and another thing…it’s crazy how his sorry no good wife abandoned him and didn’t stick by him…she just used him and got what she wanted out of him…but at the end of the day…God doesn’t like ugly..,and they will pay for lying on David like that…and then all who down talked him will feel real stupied…and just to let all u know thats my LIL BROTHER….i finally got to talk to him after 30 something years and now no telling when i will see him…we have been threw Hell as kids and now my brother is being locked up for something he didnt do…thats crazy…and rally whoever u r…lay off my brothers if u dont know crap…and yes Tony is my baby brother…love u david aka louis and tony…keep ur heads up….

    • LOL!”lay off my brothers if u dont know crap” I DO know *some* crap-like a jury convicted him. “it’s crazy how his sorry no good wife abandoned him and didn’t stick by him”-that’s nice to say!So you finally got to talk him after 30 something years?30! You tell Louis aka David hello for me!

      • First and foremost Rally…u really need to keep ur lil smart comments to urself…ur barking up the wrong branch…just cause they found him guilty doesnt mean crap…they have people testifing on people and they would be full of crap…rally…do u know that people do lie…how stupied are u…oh …i get it just cause someone says something doesnt mean there telling the truth….now laugh at that stupied!!!!!!

    • Tarry Martinez,

If you haven’t spoke to him for 30 years, how can you be so sure he’s innocent? Yes, maybe you went through Hell together as kids, but he’s a grown man now and you know very little about him– other than he continually changes his name and has engaged in at least one flight to avoid prosecution. And that a jury of his peers– who WERE privy to evidence the general public wasn’t– found him guilty beyond a reasonable doubt.

Statistically, false reports of rape are rarer than false reports of any other crime. Any man has a higher chance of being raped himself than of being falsely accused of rape. The meme that women and girls are making up false accusations of rape in droves because of being scorned by their crush or post-hookup regret is simply not true.

    • ADd me on fb Jerome McCall. please.

  19. Look..,,everyone has their own opinion about things but I know deep down inside my brother did not do that and I don’t care if I just met him Or even talked to him…whatever the case may be but I’ve had similar situations like this …that I know was a lie and to be honest my own daughter lied about a few people raping her and come to find out it never happened and the guy went to jail got beat up and everything else so can’t nobody tell me that women don’t lie about being raped so whether you guys understand or not that’s on you I just know that he’s in there for something he didn’t do and I am believing in the Lord that He will bring the truth out sometimes we have to go through stuff like this for reasons…maybe God is sitting my brother down to let him know that’s not the woman he needs to be withI don’t know it could be many things but I know God does everything for a reason..what about if one day someone just Lied on you somebody close how would you feel what would you do

    • Tarry,

It’s indisputable that SOME women lie about being raped. My point is– it’s far rarer than men lying about not raping.

A British study found that victims who make false allegations are likely to have mental health issues– including being victims of sexual abuse. More troubling– they only retracted their accusations because they were“put under pressure to admit to having made a false allegation.”

      http://msmagazine.com/blog/2013/05/07/british-study-shows-false-rape-claims-are-complicated-matters/

Both the mentally ill and survivors of a child molester’s “grooming” process are far more vulnerable to psychological pressure than the general public, raising the possibility that the rate of false allegations is even lower than the study found.

    • I think Dove is a narcissistic, manipulative, opportunist. I hope she is enjoying it in South Carolina.

      • Dove found an opportunity to marry her first love , Jonathan Welch . This is who she was with prior to meeting her husband. Jon went to prison for a violent crime and Dove moved on and married Louis aka David . Eventually after prison Jonathan gets married and has a family of his own. Jonathan and Dove reconnect some time after Jon’s wife divorced him. They rekindled their romance long before this case ever went to trial. I truly hope that Louis was not falsely accused and convicted of something so heinous just so these two could have an opportunity to start anew together. Either way it is a sad and disturbing story.

  20. Jehobahs Witnesses will protect their own no matter how guilty. *%&# Jehovah!

  21. Any more information about David?
Has a trial date been set or has the trial happened already?

  22. He was convicted for Sexual abuse of 2 girls in January of year.

    • Thanks for letting me know. What sentence did he get?

      • I don’t think he has been sentenced. It looks like he is trying to get a new trial on 3/30/15,according to the public court case records.

        • New trial for a child molester! Wtf he is a pervert and his brother and sister should be in there with him they are all deviates I sure would like to fondle doves big ol t-t–s

          • Sometimes innocent people do get convicted. Sometimes innocent people spend decades in prison before they are proven and found to be innocent.

          • Yes, new trial because he is falsely accused. His previous lawyer warned him that it only took the girls “crying” for him to lose. They didn’t have evidence. It’s a set up. The mom wins. She has full custody. She took everything away from him already. Just let him be. Let him have a chance to freedom. He’s endured enough. I’m done responding to cyberstalkers now. Waste of time.

  23. I’ve only met the family a couple of times but how I know of them is that my family belonged to the Aiea congregation of JWs. Once Dove invited my daughter and her friend to the water park with her kids, years ago. My Son who worked with Dave in field service said Dave is overly sensitive. This one particular incident was when a stray dog was near by and a brother commented (joked)that the dog better watch out in Philipino neighborhood as a joke and Dave went off about them not knowing what it feels to be a ” Stray”. This guy has problems but at the same time he probably has a lot of good. Good people getting screwed up by JW teachings.

  24. Me again, a year on!
Any more information about David and his sentence or trial etc? A link to a webpage would be appreciated too.
    Many thanks

    • He was convicted in January 2015. According to Hawaii’s court records ,Louis filed for mistrial in 2015. His request was finally denied on 4/1/16. His Sentencing will be on 6/14/16.

  25. This is what happens when you worship Jehovah!

  26. Comment he got 30 years!

  27. Could anyone ask dove to contact me? Denicebarton@gmail.com . Tell her it’s denice from texas.
