From Towamencin, Pennsylvania, 76-year-old  foster parent ,William Elliott Jr., “is charged with two felonies: indecent assault of a person under the age of 13 and endangering the welfare of children. He also faces a misdemeanor charge of corruption of minors.” He is accused of “sexually abusing the 10-year-old boy in his custody over a four-month period in 2008″ and ” had his preliminary hearing continued Thursday.”
“Elliott and his foster child shared a bed in the home and the sexual abuse occurred many times during the summer of 2008 while in Elliott’s bedroom and usually when watching TV, the complaint stated.

When they shared the bed, Elliott would allegedly place his hand on the bare skin of the child’s penis  under his pajamas and move his hand about, according to the affidavit.

The child had to remove Elliott’s hand to make him stop touching his penis, the complaint stated.”

Update: “Soon after the alleged victim, a 13-year-old boy, took the stand in the case against a Towamencin man accused of indecent assault against a child, defense attorney Brian McMahon stood up to object.

McMahon stated that he believed the boy was on some sort of narcotics that would put him to sleep.

“It looks like he was about to fall asleep on the stand,” McMahon said. “This child has a history of not telling the truth.”

District Judge Harold Borek directed McMahon and prosecutor Abigail Silverman to confer in his adjacent chambers.

Following the brief conference, which included voices audible in the courtroom, Borek held over three charges against William Elliott, Jr.

He faces charges of endangering the welfare of children, indecent assault of a person less than 13 years of age and corruption of minors.

A formal arraignment in Norristown has been has been scheduled for May 18 at 9:30 a.m., according to Borek.

According to authorities, Elliott touched the boy inappropriately several times during the summer of 2008 while he was under the man’s care as a foster parent.

In December, Towamencin police and the Montgomery County District Attorney’s Detective Bureau arrested Elliott, 75, at his home in the 800 block of Orchard Lane, according to authorities.

He was taken into custody on a warrant stemming from the investigation of a reported indecent assault of a child occurring June through September 2008, according to information provided by Tim Dickinson, chief of the Towamencin Township Police Department.

The boy testified that the inappropriate touching started soon after he moved into Elliott’s home.

Under cross examination, the alleged victim said he never told a social worker — who visited Elliott’s home weekly — about the touching because he felt uncomfortable “telling other people.”

And that he first informed his aunt and uncle.

“I knew it was wrong,” the boy said under cross examination.

McMahon questioned the alleged victim’s competency to testify.

“This child has a history of issues,” McMahon said.

The defense attorney argued that the witness was too incompetent to testify, according to Silverman, an assistant district attorney with the county.

“He tried to make credibility an issue,” she said after the hearing. “He did what he could to get it in the judge’s head that the witness does not know the difference between right and wrong.”

“A Towamencin man will be under court supervision for several years after he admitted that he endangered a child who was in his care while the boy was less than 13.

William H. Elliott Jr., 77, of the 800 block of Orchard Lane, was sentenced in Montgomery County Court Monday to two years of probation after he pleaded guilty to a misdemeanor charge of endangering the welfare of a child in connection with incidents that occurred while the child was in his care at various times between June and September 2008.

Judge Garrett D. Page, who accepted a plea agreement in the matter, ordered Elliott to have no unsupervised contact with minors during the probationary period as a condition of the sentence.

The plea agreement was hashed out between Assistant District Attorney Abby Silverman and defense lawyer Brian McVann, according to court papers.

“By pleading guilty, he is ultimately admitting that he did engage in conduct with [the child] that endangered the welfare of the child,” said Silverman, explaining the nature of the plea agreement.

Under the plea agreement, Elliott did not admit to any specific conduct but generally admitted to violating a duty of care, Silverman explained.

Originally, Elliott was charged by Towamencin detectives with indecent assault and corruption of a minor in connection with allegations he touched the boy in an inappropriate manner, court papers indicate. However, those charges were dismissed against Elliott Monday as part of the plea agreement, court papers indicate. ”
