How Could You? Hall of Shame-Hudley Owen Hamlett case-Child Death UPDATED

From Madison Heights, Virginia, Hudley Owen Hamlett, 2, died on July 31, 2025 after being left in the backseat of a car for “over eight hours,” by his foster dad, Brian Dalton.

Hudley “was found dead in the backseat of his foster father’s car last week after the man realized he had left the child strapped in the car for more than eight hours while he went to work, police allege.”

“The sheriff’s office alleged in a statement on social media that Hudley “was left unattended in a vehicle for over eight hours” before Dalton realized the child was still in the car, discovering him unresponsive in the backseat.

>Hudley was transported to Lynchburg General Hospital, where he was later pronounced dead, according to WSET.”

“Brian Dalton, was arrested and charged with child abuse and neglect, as well as involuntary manslaughter.”

Update:“A new motion to dismiss has been filed in the case of a man charged with felony child abuse and felony involuntary manslaughter after his foster child died after being left in a vehicle.

On July 30, Brian Dalton’s attorney filed a motion arguing the case should be dismissed because of improper venue.

According to court records, Dalton left his home with the child in his vehicle in July 2025. The records say the child was never taken to daycare, and Dalton drove to his workplace in Lynchburg, where the child was left in the car for the workday.

Court documents say Dalton later went to the daycare to pick up the child and discovered the child had died in the backseat.

In the motion, the counsel states, “The Commonwealth alleges criminal liability based upon the defendant’s failure to remove the child from the vehicle during the workday. That omission occurred while the vehicle was parked in the City of Lynchburg.”

The records say the defendant is asking the court to dismiss the indictments due to lack of venue, saying the proper venue for the charges is in the City of Lynchburg.

The motion to dismiss has been taken under advisement.

An additional motion was filed by Dalton’s counsel. That motion requested voir dire on the first day of trial, meaning potential jurors will be questioned to determine whether they can be fair and impartial. The judge granted that request.

The court ordered that the cases remain set on September 21-23.”
