Nevada Foster Family “Forced” to Give Up Child

“A decision by the Nevada Supreme Court means a one-year-old boy will live with his biological parents for the first time.

They lost custody of the boy at birth because of abuse to the boy’s older sister. When he was born, he was placed into the same foster home as his four-year-old sister.

The children were sent to the home of JD Smith because at five-weeks-old, the boy’s sister ended up with a fractured skull.

Since the boy’s birth, there has been a custody battle for him. Earlier this year, a judge ruled the boy be returned to his biological parents because there was no proof his parents would harm him.

The case went all the way to the Supreme Court and on Friday, it agreed with the ruling of the Family Court: The boy should be returned to his biological parents.

“Heart-wrenching to love somebody like they’re your own family and have to say goodbye, and know there is a possibility you won’t see them again, and the uncertainly they have to face. It’s devastating for a parent, but then watching my children who’ve bonded with him as their brother, suffering and crying, and there’s nothing I can do to fix it. Devastating,” said Smith.

The biological parents are also trying to get their daughter back, but their parental rights were terminated.

Both families are also waiting on the Nevada Supreme Court to see whether that girl will stay with the foster family she has lived with for the last four years or be returned to the parents who the courts say at one point abused her.”
