“Notice: Only U.S. Citizens may File a Form I-800A or Form I-800

This is an update to our notice dated March 6, 2014 announcing that India opened online registration for Non-resident Indian (NRI) prospective adoptive parents seeking to adopt Indian children not classified as special needs.  The Indian Central Adoption Resource Authority (CARA) continues to accept online registrations from Enlisted Foreign Adoption Agencies (EFAAs) on behalf of individuals who have NRI status for this expanded group of eligible children (see CARA’s January 1, 2014, announcement) and who are completing a Hague Convention adoption.  This notice seeks to clarify which NRIs are eligible to pursue an adoption under the Hague Convention adoption process.

U.S. Citizen NRI Prospective Adoptive Parents

Only U.S. citizens may file the necessary U.S. immigration forms (Form I-800A Application for Determination of Suitability to Adopt a Child from Convention Country and Form I-800Petition to Classify Convention Adoptee as Immediate Relative) to adopt an Indian child not classified as special needs under the Hague Convention adoption process.  If both NRI spouses are U.S. citizens either spouse may serve as the primary applicant/petitioner.

Non-U.S. Citizen NRI Prospective Adoptive Parents

A NRI living in the U.S. as a permanent resident and who is married to a U.S. citizen (whether NRI or not), may also adopt an Indian child not classified as special needs under the Convention adoption process.  However, only the U.S. citizen spouse may file the Form I-800A/I-800 as the primary applicant/petitioner.

Update: See here:”Notice: Exit Permits Required for Adoptive Parents to Depart India

On October 21, 2015, the Indian government informed the U.S. Embassy in New Delhi that adoptive parents must possess an exit permit issued by the Foreigners Regional Registration Office (FRRO) in New Delhi before departing India with their adopted or prospective adoptive child. Families may contact the FRRO support desk by telephone at + 91 11 2671-1443 or by e-mail at frrodli.support@nic.in or frrodli.support@gov.in for assistance in processing the exit document. As per FRRO, parents can apply for the exit permit at the FRRO in New Delhi after receiving their child’s U.S. immigrant visa.

The U.S. Embassy does its best to ensure that U.S. immigrant visas for adopted and prospective adoptive children are issued as expeditiously as possible. Visa issuance after the interview takes at least one business day. It is not possible to provide the visa to adoptive parents on the day of the interview. We strongly recommend that parents not purchase non-exchangeable, non-refundable airline tickets until they have their visa and exit permits in hand, or at least allow ample time to obtain these documents before planning to travel.

“Parents Must Now Obtain a “No Objection Certificate” (NOC) from the Foreigners Regional Registration Office (FRRO) before Departing India

The Foreigners Regional Registration Office (FRRO) advises that adoptive parents must obtain a no objection certificate (NOC) from the FRRO prior to departing India.  India’s Central Adoption Resource Authority (CARA) issues its own NOC and informs FRRO, but FRRO airport staff requires a second NOC, issued by the FRRO.  Adoptive parents do not require an exit permit.

Should adoption service providers or their families have any issues or concerns, please contact the U.S. Embassy in New Delhi directly by email atNDAdopt@state.gov.  In case of an emergency involving a U.S. citizen, please call the 24-hour operator at (+91-11) 2419-8000 and ask for American Citizen Services.  If you are calling from within India, but outside Delhi, first dial 011.  If you are calling from the United States, dial 011-91-11 first.”
