Moldova Advisory Board for International Adoptions

Following judicial reforms over the past few years and the late 2010 change to full adoption visa processing in Moldova, new adoption laws in Moldova have been passed in 2011. The specifics of the new process have been under discussion over the past few months. Specifics surrounding a new family bonding time requirement and a new longer mandatory length of time that children will need to remain on the adoption list before being allowed to be internationally adopted have been particular confusion points as the law has some vagueness in its wording. The case managers and territorial authorities will in part determine these new requirements.

Agency accreditation and new dossier acceptance have been on hold for at least one month pending these changes. It appears from these new articles that the changes will go into effect this Fall.

The US Department of State rarely updates information about Moldovan adoptions.


On July 20, 2011, the Government of the Republic of Moldova announced the following:
“Under another decision, the government created the Advisory Board for International Adoptions and approved a regulation of its activity. Also, the cabinet approved a regulation of the procedure of accrediting and the functioning of foreign organizations dealing with international adoption in Moldova, as well as a list of international adoption services and activities they may carry out.”

New Judicial Reforms

A few days later, ” [t]he Moldovan and US governments on 22 July signed the agreement of assistance for the programme Strengthening Rule of Law Institutions in Moldova, the government s communications and press relations department has said.

Prime Minister Vlad Filat signed the document on Moldova s behalf and the USAID regional director for Ukraine, Moldova and Belarus, Robin Phillips, on the USA s behalf. US Extraordinary and Plenipotentiary Ambassador to Moldova Asif J. Chaudhry countersigned the accord.”

” The prime minister said that ensuring an independent justice is a must in a state based on the rule of law, specifying that ever since Moldova proclaimed its independence, the justice reform has been among the major objectives, which, among others, requires significant support.

“The agreement we signed today is a component of this support that we are happy and thankful to receive it from the American people. It is one of the numerous projects of sincere assistance from the US Government in a sector in which foreign support is an essential pre-requisite for success,” Filat said. He specified that from the first instalment [sic] regulated by this agreement, the US Agency for International Development will contribute 2.1 million dollars, with the overall sum due to amount to 8.8 million dollars by 30 September 2015.

Filat also said that the agreement will back the government s efforts to create new mechanisms for promoting, motivating and rendering more responsible the judges and prosecutors, to create a new framework which would secure an efficient operation of the self-administered bodies of the justice sector, will reinforce the independence, responsibility and transparency of the justice system.

” At the same time, Filat said that the judiciary reform cannot be approached in a fragmentary manner because for the act of justice to be efficiently carried out, joint and efficient steps by key institutions are needed, in particular by the courts from all the links of the justice system, the Constitutional Court, the Prosecutor-General s Office, the criminal investigation bodies, the Superior Council of Magistrates, the National Justice Institute and others. Concurrently, it is necessary to ensure higher transparency and more responsibility of the justice system in Moldova, not only by stepping up the structural and operational capacities of all its institutional pillars and by training the staff , but also by reinforcing the capacities of civil society to monitor, signal and intervene in the reform. ”

On August 2, 2011, the US Senate Confirmed William H. Moser, of North Carolina, a Career Member of the Senior Foreign Service, Class of Minister-Counselor, to be Ambassador Extraordinary and Plenipotentiary of the United States of America to the Republic of Moldova.

” An Advisory Board for International Adoptions will begin operating in Moldova in September 2011, Labour, Social Protection and Family Minister Valentina Buliga said at a news conference today.

The board aims at ensuring the observance of children s rights when they are adopted abroad. The body will comprise representatives of the relevant ministry, civil society and ombudsman for child rights.

At the same time, Buliga said that under the new law on juridical status of adoption, a register of children to be adopted and a register of families willing to adopt children will be created.”

” An adoption promoting campaign will begin in Moldova in autumn, Buliga added.

The number of children adopted by Moldovan families halved in 2006-10. About 162 minors were adopted in Moldova in 2010. The number of children adopted abroad is decreasing as well, with 51 children being adopted in 2006 and 45 in 2010. Most Moldovan children were adopted by families from Italy and the USA, Buliga noted.”

“The adoption period cannot be exactly determined because there are many procedures that depend on different factors. The statement was made for Info-Prim Neo by Minister of Labor, Social Protection and Family Valentina Buliga. She said that if a child couldn’t be easily integrated into the family that wanted to adopt him or her, the procedure could take longer, but no more than two years.

Valentina Buliga explained that the first step to adopt a child was to submit a application to the territorial authority according to their residence. The application must have several documents attached to it: the marriage certificate, copies of the spouses’ IDs, information about their income and living conditions, etc. The court will accept the application only if it is convinced that the couple’s intentions are sincere and noble.

According to the Minister, the competent authority must check all the papers, prepare its own set of documents and adopt the decision to introduce the applicants in the Registry of families that wish to adopt a child. “After being included in the Registry, there is the next step involving specialists, when the child is integrated in the adopting family. Experts train the parents and then come with the approval of the adoption decision”, said Valentina Buliga.

There are 220 children waiting for adoption and 437 families wanting to adopt one in the Registry.”
